These Terms of Service ("Terms") govern your access to and use of the Vervalis mobile application and related services (the "App"). The App is operated by the developer of Vervalis, based in Türkiye ("Vervalis", "we", "our", or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, for your own personal, non-commercial use. You may not:
The App offers optional paid subscriptions ("Vervalis Pro") that unlock additional features and usage credits. The following terms apply to all subscriptions:
Vervalis provides plant identification, health diagnosis, care schedules, and AI-generated guidance for informational purposes only. These features rely on automated models and may be inaccurate or incomplete.
You use plant guidance at your own risk and are solely responsible for the care and handling of your plants.
You retain ownership of the photos, notes, and other content you submit to the App ("Your Content"). By submitting Your Content, you grant us a limited license to host, store, process, and transmit it solely to operate and provide the App's features to you — including sending photos and messages to our service providers for processing as described in our Privacy Policy. You are responsible for ensuring you have the right to submit Your Content and that it does not violate any law or third-party right.
You agree not to use the App to:
The App, including its software, design, text, graphics, logos, and the "Vervalis" name and brand, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted above, these Terms do not transfer any rights to you.
The App relies on third-party services (including app stores, cloud, AI, and subscription providers) to function. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services and do not control them.
The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results obtained from it will be accurate or reliable.
To the maximum extent permitted by law, Vervalis and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, plants, profits, or goodwill, arising out of or related to your use of the App. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the App in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the App or other users. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
We may modify or discontinue features of the App, and we may update these Terms from time to time. Material changes will be communicated within the App or by updating the date above. Your continued use of the App after an update constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Mandatory consumer protections in your country of residence continue to apply.
If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Vervalis only, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

Bu Hizmet Şartları ("Şartlar"), Vervalis mobil uygulamasına ve ilgili hizmetlere ("Uygulama") erişiminizi ve bunları kullanımınızı düzenler. Uygulama, Türkiye merkezli Vervalis geliştiricisi ("Vervalis", "biz") tarafından işletilir. Uygulamayı indirerek, erişerek veya kullanarak bu Şartları kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın.
Uygulamayı kullanabilmek için en az 13 yaşında olmalısınız. Bulunduğunuz ülkede reşit değilseniz, Uygulamayı yalnızca bir ebeveyn veya yasal vasinin katılımı ve onayı ile kullanabilirsiniz. Uygulamayı kullanarak bu koşulları karşıladığınızı beyan edersiniz.
Bu Şartlara tabi olmak kaydıyla, size; sahip olduğunuz veya kontrol ettiğiniz bir cihazda, kişisel ve ticari olmayan kullanımınız için Uygulamayı indirip kullanmanız üzere sınırlı, kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz. Şunları yapamazsınız:
Uygulama, ek özellikler ve kullanım kredileri sunan isteğe bağlı ücretli abonelikler ("Vervalis Pro") sunar. Tüm aboneliklere aşağıdaki koşullar uygulanır:
Vervalis; bitki tanıma, sağlık teşhisi, bakım programları ve AI tarafından üretilen rehberliği yalnızca bilgilendirme amacıyla sunar. Bu özellikler otomatik modellere dayanır ve hatalı veya eksik olabilir.
Bitki rehberliğini kendi sorumluluğunuzda kullanırsınız ve bitkilerinizin bakımından yalnızca siz sorumlusunuz.
Uygulamaya gönderdiğiniz fotoğraf, not ve diğer içeriğin ("İçeriğiniz") mülkiyeti sizde kalır. İçeriğinizi göndererek, yalnızca Uygulamanın özelliklerini işletmek ve size sunmak amacıyla — bunu işlemek üzere fotoğraf ve mesajları Gizlilik Politikamızda açıklandığı şekilde hizmet sağlayıcılarımıza göndermek dahil — bunu barındırmamız, saklamamız, işlememiz ve iletmemiz için bize sınırlı bir lisans verirsiniz. İçeriğinizi gönderme hakkına sahip olduğunuzdan ve içeriğin hiçbir yasayı ya da üçüncü taraf hakkını ihlal etmediğinden emin olmaktan siz sorumlusunuz.
Uygulamayı şu amaçlarla kullanmamayı kabul edersiniz:
Yazılımı, tasarımı, metinleri, grafikleri, logoları ve "Vervalis" adı ile markası dahil Uygulama, bize veya lisans verenlerimize aittir ve fikri mülkiyet yasalarıyla korunur. Yukarıda verilen sınırlı lisans dışında, bu Şartlar size herhangi bir hak devretmez.
Uygulama, çalışabilmek için üçüncü taraf hizmetlere (uygulama mağazaları, bulut, AI ve abonelik sağlayıcıları dahil) dayanır. Bu hizmetleri kullanımınız, onların kendi koşullarına ve politikalarına tabi olabilir. Üçüncü taraf hizmetlerden sorumlu değiliz ve onları kontrol etmeyiz.
Uygulama, açık veya zımni hiçbir garanti olmaksızın "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur; ticarete elverişlilik, belirli bir amaca uygunluk, doğruluk ve ihlal etmeme garantileri dahil. Uygulamanın kesintisiz veya hatasız olacağını ya da ondan elde edilen sonuçların doğru veya güvenilir olacağını garanti etmeyiz.
Yasaların izin verdiği azami ölçüde, Vervalis ve geliştiricisi; Uygulamayı kullanmanızdan kaynaklanan veya bununla ilgili dolaylı, arızi, özel, sonuç niteliğindeki ya da cezai zararlardan veya herhangi bir veri, bitki, kâr ya da itibar kaybından sorumlu olmayacaktır. Sorumluluğun hariç tutulamadığı ölçüde, toplam sorumluluğumuz, talebe yol açan olaydan önceki on iki ayda Uygulama için bize ödediğiniz tutarla sınırlıdır. Bu Şartlardaki hiçbir hüküm, geçerli mevzuat uyarınca sınırlandırılamayan sorumluluğu sınırlamaz.
Uygulamayı kullanmayı istediğiniz zaman bırakabilir ve hesabınızı silebilirsiniz. Bu Şartları ihlal etmeniz halinde ya da Uygulamayı veya diğer kullanıcıları korumak için gerekliyse erişiminizi askıya alabilir veya sonlandırabiliriz. Niteliği gereği fesihten sonra da geçerli kalması gereken hükümler (fikri mülkiyet, sorumluluk reddi ve sorumluluğun sınırlandırılması dahil) yürürlükte kalır.
Uygulamanın özelliklerini değiştirebilir veya durdurabilir ve bu Şartları zaman zaman güncelleyebiliriz. Önemli değişiklikler Uygulama içinde bildirilir veya yukarıdaki tarih güncellenir. Bir güncellemeden sonra Uygulamayı kullanmaya devam etmeniz, revize edilmiş Şartları kabul ettiğiniz anlamına gelir.
Bu Şartlar, kanunlar ihtilafı ilkelerine bakılmaksızın Türkiye Cumhuriyeti yasalarına tabidir. İkamet ettiğiniz ülkedeki emredici tüketici korumaları geçerliliğini korur.
Uygulamayı Apple App Store'dan edindiyseniz, bu Şartların yalnızca sizinle Vervalis arasında olduğunu, Apple ile olmadığını ve Apple'ın Uygulamadan veya içeriğinden sorumlu olmadığını kabul edersiniz. Apple'ın Uygulama için bakım veya destek sağlama yükümlülüğü yoktur. Uygulamanın geçerli bir garantiye uymaması durumunda Apple'ı bilgilendirebilirsiniz; Apple varsa satın alma bedelini iade edebilir ve yasaların izin verdiği azami ölçüde başka bir garanti yükümlülüğü taşımaz. Apple ve iştirakleri bu Şartların üçüncü taraf lehdarlarıdır ve Şartları size karşı uygulayabilir. ABD Hükümeti ambargosu uygulanan bir ülkede bulunmadığınızı ve herhangi bir ABD Hükümeti kısıtlı taraflar listesinde yer almadığınızı beyan edersiniz.
